Important Notice - Meeting Cancelled
This Board Meeting was cancelled due to a delay in providing the meeting agenda. The agenda was provided less than 24 hours prior to the meeting. CCIOA and our Governing Documents require that agendas be made reasonably available to all members. The Board discussed this issue with our legal counsel, Altitude Community Law. Altitude Community Law determined that less than 24 hours notice was not reasonably available. The Board was advised that they would not be able to conduct business during this meeting. The Board elected to cancel the meeting and defer the agenda items to the 2024-10-19 Board Meeting.

"An agenda is a list of items to be considered, discussed, or decided at a meeting. The agenda is intended to give notice to the possible attendees of the issues to be discussed and voted upon at the upcoming meeting. This allows interested individuals an opportunity to attend meetings and hear and/or participate in various discussions and votes on matters of interest to them.
Agendas for meetings of the executive board are required to be made “reasonably available” for examination by all members of the association. This typically means, copies of the board meeting agendas should be brought to such meetings and provided to owners who attend."
Opinion
Unlike an HOA in a condominium building or a more urban subdivision, our HOA community covers a wide geographical area. Additionally, many members reside outside of the community and across the United States and multiple time zones. As such, "reasonably available" for our members should be access to the meeting agenda long before the meeting. This allows our members to determine if they would like to attend the particular meeting and to make the proper arrangements to attend.
